Rules and Regulations

1. Introduction.

1.1 The Hunger Games Explorer Sparks Program (the "Program") is a paperless, electronic fan rewards program operated by or on behalf of Lions Gate Films Inc. ("Lionsgate"). The Program provides members of the Program ("Members" or "you") with the opportunity to earn points called "Sparks" or badges and other virtual assets, by participating in various activities, some of which are described below. The accumulation of Sparks may unlock various "Prizes," as set forth below, and in some instances you may redeem your Sparks from time to time for various Prizes. These Rules and Regulations govern the Program. Please read these Rules and Regulations carefully before participating in the Program. Your participation in the Program indicates that you have read, accepted and unconditionally agreed to these Rules and Regulations. If you do not agree to these Rules and Regulations, you may not participate in the Program. The Program is only for your own personal use. Members may not use the Program for commercial purposes, or in any way that harms Lionsgate or any other person or entity, as determined by Lionsgate in its sole discretion. The Terms of Use http://lionsgate.com/terms.html and privacy policy http://lionsgate.com/privacy.html for the Program's website, located at www.thehungergamesexplorer.com ("THGE") are incorporated herein by this reference. THGE and thecapitol.pn and other websites owned and operated by Lionsgate that periodically participate in the Program are collectively referred to herein as the "Website". Facebook Inc. ("Facebook") and Twitter Inc, ("Twitter") are not sponsors of, nor are they affiliated with the Program.

2. Eligibility.

2.1 The Program is open only to legal residents of the fifty (50) United States and the District of Columbia who are thirteen (13) years of age or older as of the time of participation and who have either a valid Facebook or Twitter account in good standing. Those under the age of majority in their state/province and country of residence must get their parent or legal guardian's permission to participate. Officers, directors and employees of Lionsgate and its respective parents, subsidiaries, divisions and affiliates, (collectively, "Program Entities") may participate in the Program but may not be allowed to redeem Sparks for certain Prizes and may otherwise be subject to restrictions that do not generally apply to how Sparks are earned or used. To become a member of the Program, go to the Website, follow the instructions requested on the registration page to connect either your Facebook Account or Twitter Account and confirm your agreement to these terms and conditions, the Website's Terms of Service and Privacy Policy. Once you complete the registration process ("Registration") you will be enrolled in the Program, and a Program account (each, an "Account") will be created for you. All required registration information must be completed in full. Memberships can only be used by the Member whose email address is registered to the Account. You should not give your password to any other person. You are responsible for all activity in your Account. You cannot have more than one (1) Account. If you attempt to obtain more than one (1) Account, Lionsgate may terminate your membership and all Sparks in your Account may be forfeited. Additional or different eligibility criteria may apply to certain opportunities to earn Sparks and other invitations made by the Program Entities or their business partners. Limit one (1) Account per person and two (2) Accounts per household/mailing address. The Program is provided to individuals only. Corporations, associations, or other groups may not participate in the Program. It is fraudulent for any individual, company, Program, association or group to use or to direct, encourage, or allow other persons to use a single Account for the purpose of accumulating or aggregating Sparks for combined use, unless such use is expressly permitted by Lionsgate. %}

3. Earning Sparks.

3.1 There are many ways to earn Sparks on the Website, thecapitol.pn or through programs and invitations offered by the Program Entities alone or in conjunction with Lionsgate's business partners. Some of the ways to earn Sparks include the following:

3.1.1 Sharing Content With Friends. From time to time, the Website will provide Members with an opportunity to "share" content from the Website with friends (e.g., through a Facebook or Twitter account) in order to earn Sparks. Additional instructions explaining how to share the content will be set out on the Website in connection with each such opportunity.

3.1.2 {% trans 'Submitting Content to the Program.' % From time to time, the Website will provide Members with an opportunity to submit original content (e.g., a photograph or caption) in order to earn Sparks. When the Website provides you with the opportunity to submit content, the type of content and any additional terms and conditions in connection with such content will be set out on the Website. For clarification and the removal of doubt, any content you submit to the Program or the Website will be considered a "Submission" pursuant to the Website's Terms of Service."

3.1.3 Other Online Opportunities. From time to time, Lionsgate may provide Members with opportunities to earn Sparks by completing various actions on the Website (each, an "Online Sparks Opportunity"). Online Sparks Opportunities include, but are not limited to: (i) inviting a friend to join the Program or (ii) entering a sweepstakes or contest. Please visit the Website for the complete details of any Online Sparks Opportunity, which are subject to change or preemption without notice.

3.2 The Program may award more than one type or "class" of Sparks. The number and type of Sparks ("Sparks Level") that can be earned by participating in any opportunity to earn Sparks will be disclosed when the opportunity is presented. There may be a delay from the time the activity is completed to when the Sparks appear in your account. In accumulating Sparks, you may not rely upon continued Sparks or Sparks Levels. Lionsgate, in its sole discretion and without notice to you, reserves the right to change, modify, withdraw or cancel any Sparks or Sparks Level.

4. SWEEPSTAKES.

4.1 From time to time, Lionsgate may hold online or offline contests or sweepstakes (solely for ease of reference each, a "Sweepstakes") in connection with the Program. Sparks may be earned in connection with some of those Sweepstakes, either as a bonus for entering, as a prize that can be won or otherwise. In each such Sweepstakes, the available prizes and the number of possible prize winners will be set out in the advertising or promotional materials soliciting entries for the Sweepstakes or the Sparks-earning opportunity in question (the "Promotional Materials"). Unless otherwise indicated in the Official Rules or Promotional Materials for the particular Sweepstakes, entry into one Sweepstakes does not constitute entry into any other promotion, contest or sweepstakes. In addition, if a promotion offered by any of the Program Entities has a set of Official Rules that apply specifically to that promotion, the terms of those specific Official Rules (as opposed to this Paragraph 4) will govern that specific promotion. By participating in any of the Sweepstakes that are offered, each entrant unconditionally accepts and agrees to comply with and abide by this Paragraph 4 and the decisions of Lionsgate, which shall be final and binding in all respects. Sweepstakes are void where prohibited.

4.2 Eligibility. Sweepstakes are open to legal residents of the fifty (50) United States and the District of Columbia who are thirteen (13) years of age or older as of the time of entry. Those under the age of majority in their state of residence must get their parent or legal guardian's permission to enter. Program Entities and their immediate family members (mother, father, brothers, sisters, sons, daughters and spouse) and/or those living in the same household of any such employees, whether or not related, are ineligible to enter any of the Sweepstakes or win a prize. Limit one (1) prize per Account/person/family/household per Sweepstakes and one (1) prize per Account/person/family/household during any thirty (30) day period for any Sweepstakes conducted by Lionsgate.

4.3 How to Enter. To enter an online Sweepstakes you will need to interact with the online entry mechanic that has been set up for the applicable Sweepstakes, which may take the form of an entry page on a website that is owned or controlled by a Program Entity or an applicable Lionsgate business partner, a widget, a social networking page or some other mechanic (each, for ease of reference, referred to in this Paragraph 4 as a "Promotional Website") that asks for certain information in order to complete the entry. Any other methods of entry will be communicated on the Promotional Website or as part of the Promotional Materials soliciting entries for the Sweepstakes in question. The entry deadline for each Sweepstakes will be on the Promotional Website or the corresponding Promotional Materials as will be the limit to the number of entries, if any. All entries must be received before the applicable entry deadline in order to participate. The Promotional Website's database clock will be the official time keeper for each Sweepstakes.

If an alternative method of entry is offered in connection with any Sweepstakes, then unless otherwise set forth in the applicable Promotional Materials, to enter via mail (available for all eligible entrants): hand print in ink on a on a 8½" x 11" sheet of paper, the name of the sweepstakes, your full name, complete home address and zip code, home telephone number and area code, month and year of birth. Mail your completed entry form in a business size (#10) envelope with proper postage affixed to: Attn: The Hunger Games Sparks Program, 2700 Colorado Ave., Suite 200, Santa Monica, CA 90404. No metered mail will be accepted. No copies, facsimiles or mechanical reproductions will be accepted. Lionsgate assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage due entries or mail. Limit one (1) entry per outer mailing envelope. Mail-in entries are also subject to any other generally applicable entry limits.

NOTE: Internet entry must be made by the entrant, only at the applicable Promotional Website. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified. The use of any device to automate the entry process is prohibited.

4.4 Winner Notification. The potential winner(s) of each Sweepstakes will be notified using the email address provided at the time of Registration. The notification email may ask the winner (or, or if such winner is under the age of majority in his or her state of residence [a "minor"] such minor's parent or legal guardian) to provide contact information so that Lionsgate can send the prize to the winner. Lionsgate shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If a potential winner does not respond within forty-eight (48) hours of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with this Paragraph 4 or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. In the event of a dispute as to the identity of the entrant, the affected entry will be deemed submitted by the Account holder, provided such Account holder must still meet the eligibility requirements for the Sweepstakes. A potential winner may be requested to provide Lionsgate with proof that the potential winner is the Account holder associated with the winning entry. If a dispute cannot be resolved to Lionsgate's satisfaction, the affected entry will be deemed ineligible.

4.5 Prizes/Odds. The prizes that are offered in each Sweepstakes will be described in the Promotional Materials or otherwise as part of the Sweepstakes entry process. Prizes pictured or described in the Promotional Materials or otherwise are for illustrative purposes only. All aspects of prizes not otherwise described will be determined by Lionsgate in its sole discretion. No cash alternative or substitution of prizes will be allowed, except Lionsgate reserves the right in its sole discretion to substitute prize(s) of comparable or greater value if any prize is unavailable, in whole or in part, for any reason. Odds of winning a Sweepstakes whose outcome is based on chance depend on the number of eligible entries received for that Sweepstakes.

4.6 General Prize Conditions. Each prize winner is responsible for paying any federal, state and/or local taxes and for any other fees or costs associated with the applicable prize. If required by law, as determined by Lionsgate in its sole discretion, Lionsgate reserves the right to withhold (or collect) and remit to the appropriate taxing authorities the amount of any taxes due. Prizes will be delivered only to an address in the United States or Canada. The potential winner (or, if the potential winner is a minor, his or her parent or legal guardian) may be required to execute an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, "Prize Claim Documents"). If a winner (or a minor winner's parent or legal guardian) fails or refuses to sign and return all Prize Claim Documents within ten (10) days of prize notification (or a shorter time if required by exigencies), such winner may be disqualified and an alternate winner may be selected.

4.7 General Release. Participation in a Sweepstakes constitutes each entrant's (and any minor entrant's parent or legal guardian) permission for the Program Entities and those of Lionsgate's business partners that are involved in the Sweepstakes in question to use entrant's first and last name, username, photograph, likeness, voice, biographical information, statements, address (city and state) and a description of the prize(s) won and any other personal characteristics for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. Entrants agree that the Program Entities and those of Lionsgate's business partners that are involved in the Sweepstakes in question shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants' acceptance, receipt, possession and/or use or misuse of any prize. Lionsgate assumes no responsibility for any damage to an entrant's computer system which is occasioned by accessing the Promotional Website or participating in a Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Lionsgate is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Lionsgate reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of a Sweepstakes or the Promotional Website, to be acting in violation of this Paragraph 4, or to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of a Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Lionsgate reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software generated or other automated multiple entries will be accepted. Lionsgate reserves the right to modify, extend, suspend, or terminate any Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Lionsgate's control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Lionsgate will (if possible) select winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Only the type and quantity of prizes described on the Sweepstakes entry page corresponding with a particular Sweepstakes will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in this Paragraph 4, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant's sole and exclusive remedy under such circumstances. This Paragraph 4 cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Lionsgate. The invalidity or unenforceability of any provision of this Paragraph 4 shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, this Paragraph 4 shall otherwise remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein.

4.8 Winner's List. If Lionsgate so elects or if legally required, the first name and last initial of the prize winners and/or the prize winners' usernames will be posted on the applicable Promotional Website.

5. Sparks Redemption AND PRIZES.

5.1 As Members accumulate Sparks certain digital or other virtual assets and other awards of any type or nature as determined by Lionsgate (each, an "Prize") maybe "unlocked" or awarded to the Member once the Member reaches certain thresholds of Sparks. In some instances, Members may redeem Sparks for Prizes as featured on THGE or other Lionsgate websites or Lionsgate partner websites. Instructions for redeeming Sparks will be disclosed when the redemption opportunity is presented. Lionsgate, in its sole discretion, may change the threshold levels of Sparks needed in order to obtain a Prize, impose a limit on the number of Prizes in the aggregate or by type that may redeemed per Account, per day, per Prize or per any other generally-applicable metric that may be selected by Lionsgate from time to time in its sole discretion.

5.2 Prizes are subject to availability as determined by Lionsgate in its sole discretion. Lionsgate reserves the right to modify, amend or revise the Prizes available. Members may not rely on continued Prize availability. The amount of Sparks required to redeem or unlock any Prize may be substantially increased, any Prize may be withdrawn, and restrictions on any Prize or its redemption may be imposed by Lionsgate or its designee or the third party business partner supplying the Prize in their sole discretion. Prizes are non-assignable and non-transferable. Lionsgate reserves the right to substitute Prizes of comparable or greater value if any redeemed Prize is unavailable for any reason. Physical real-world Prizes will generally be fulfilled within six (6) to eight (8) weeks from date of redemption. Digital Prizes will generally be fulfilled within twenty-four (24) hours from the date the threshold was met. Prizes pictured in Promotional Materials, point-of-sale, online, television and print advertising, promotional packaging, and other Program materials are for illustrative purposes only.

5.3 All details and restrictions of the Prizes not specified on THGE or otherwise at the time the redemption opportunity is presented will be determined by Lionsgate in its sole discretion. Some Prizes may require additional terms and conditions in order to redeem, including, but not limited to, age limitations, geographical limitations or any other restrictions or conditions determined by Lionsgate in its sole discretion. Members shall be solely responsible for all federal, state, and/or local taxes including, without limitation, income taxes and any reporting consequences thereof in connection with an Prize. If required by law, as determined by Lionsgate in its sole discretion, Lionsgate reserves the right to withhold and remit to the appropriate taxing authorities the amount of any taxes due.

5.4 Sparks have no cash value and may not be redeemed for cash and may not be sold, auctioned, bartered, brokered, purchased or used to engage in any gambling activity. Any Sparks obtained in this manner by any person or entity will be considered to have been fraudulently obtained and deemed void. Sparks must be redeemed in accordance with these Rules and Regulations. Sparks will not be replaced, reissued or credited if lost, stolen or otherwise altered or destroyed. Sparks may expire on a certain date as expressly contemplated in the Promotional Materials or as otherwise communicated to Members by Lionsgate. Lionsgate in its sole discretion may allow Members to prevent their Sparks from expiring by following Lionsgate's instructions. Lionsgate reserves the right, in its sole discretion, to determine and modify, at any time, the value of Sparks and the amount of Sparks that may be earned for any given activity. Sparks cannot be used in combination with any other discount, coupon or offer unless specifically allowed by the terms of a specific promotion.

5.5 You can view your Sparks Account balance and a limited transaction history by logging onto your Account.

6. SUBMISSIONS

6.1 In certain instances, Members may be permitted to upload text, images or other content to the Website (a "Submission"). Lionsgate's policy regarding Submissions, located in the Terms of Use http://lionsgate.com/terms.html, govern any and all such Submissions.

6.2 If you choose to upload a Submission, your Submission may not contain, include, depict, promote, or represent:

6.3 Submissions may not raise money for anyone or advertise or promote a product, service, pyramid scheme, or other multi-tiered marketing scheme. Please don't use misleading descriptions, tags, or titles, or post large amounts of untargeted, unwanted, or repetitive content, including comments and private messages.

6.4 All Submissions must comply with the Terms of Use, these Rules and Regulations and the Privacy Policy.

6.5 Once a Submission is submitted you will not be able to edit it. Lionsgate reserves the right to refuse to publish any Submission. Submissions may be shared by other Members on their own social channels outside of the Website.

6.6 Recommended image size at least 480 x 360, or a larger image with a 4:3 aspect ratio or other size as specified during the submission process.

7. MODIFICATION AND TERMINATION.

7.1 Lionsgate may modify any of these Rules and Regulations, including, but not limited to, the methods through which Sparks can be earned, how Sparks can be used, the types or "classes" of Sparks available, and the conditions under which Sparks may expire or be forfeited, at any time, with or without notice, even though these changes may affect a Member's ability to use the Sparks that he/she has already earned. The Program has no predetermined termination date and may continue until such time as Lionsgate decides to terminate the Program. Lionsgate may, in its sole discretion, modify or terminate the Program at any time or restrict access to the Website or the Program for those located within any particular country or region,with notice on the Website and/or via email to the Member's email address currently on file with Lionsgate for their Account.

7.2 Members will have up to six (6) months from the date the Program termination is announced to use their remaining Sparks. Use of any remaining Sparks will be on a first come, first serve basis and otherwise subject to the availability of Prizes and Sweepstakes. Members may not rely on continued Prize and Sweepstakes availability. Lionsgate makes no representation or warranty about the number or type of Prizes that may be available after the Program termination has been announced, and many Prizes that may have been available prior to termination will quickly become depleted or otherwise unavailable once the Program termination has been announce. Any Sparks remaining in a Member's Account at the time of termination will be forfeited and no compensation will be provided. Lionsgate may cancel your membership, cancel accumulated Sparks, alter the amount of Sparks in your Account or suspend your membership privileges at any time with immediate effect if Lionsgate determines in its sole discretion that you (a) have acted in a manner inconsistent with applicable laws or ordinances; (b) acted in a fraudulent or abusive manner; (c) breached any of these Rules and Regulations; (d) engaged in any fraud or abuse concerning Sparks or Sparks usage; or (e) engaged in any conduct or act that causes Lionsgate to terminate or suspend your access to the Website or any other website owned or operated by the Program Entities. Lionsgate may also take appropriate administrative or legal action if any of the items listed above occurs. Nothing contained in these Rules and Regulations shall limit Lionsgate in its exercise of any legal or equitable rights or remedies.

7.3 Lionsgate reserves the right to terminate the membership of any Member whose Account becomes dormant. An Account will be considered dormant if the Account holder fails to log onto his or her Account for twelve (12) months or with such regularity deemed sufficient by Lionsgate and announced from time to time on the Website. If a Member terminates his or Account, all Sparks in such Member's Account will automatically expire.

7.4 If Lionsgate amends these Rules and Regulations, it will revise the "last updated" date located at the bottom of these Rules and Regulations. For changes to these Rules and Regulations that Lionsgate considers to be material, Lionsgate will place a notice on the Website by revising the link on the home page to read substantially as "Updated Sparks Rules and Regulations" for a reasonable amount of time. If you continue to participate in the Program by earning Sparks, redeeming Sparks, logging onto your Account or in any other way after these Rules and Regulations have been changed, you will be deemed to have read, understood and unconditionally consented to and agreed to such changes. The most current version of these Rules and Regulations will be available on the Website and will supersede all previous versions of these Rules and Regulations.

8. PUBLICITY RELEASE

Becoming a Member and participating in the Program constitutes each Member's (and any minor Member's parent or legal guardian) permission for the Program Entities to use Member's first and last name, username, photograph, likeness, voice, biographical information, statements, address (city and state) and any other personal characteristics or Member Account information for use on the Website and for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. Lionsgate may choose, at its discretion, a Member to feature as a "Featured Fan" using criteria determined by Lionsgate and may award such Member certain Prizes or Sparks.

9. GENERAL TERMS AND CONDITIONS.

9.1 ACCRUED SPARKS DO NOT CONSTITUTE PROPERTY OF A MEMBER AND HAVE NO VALUE OUTSIDE OF THE EXPERIENCE. SPARKS ARE CREDITS THAT LIONSGATE MAY REVOKE AT ANY TIME AS SET FORTH HEREIN. SPARKS ARE NOT TRANSFERABLE UPON DEATH, AS PART OF A DOMESTIC RELATIONS MATTER OR OTHERWISE. Each Member is responsible for ensuring that the information in his/her Account is accurate and is kept current. If a Member believes that his/her Account does not properly reflect Sparks earned from engaging in any activities, the Member must contact Lionsgate to resolve the issue. Any attempt by any person to undermine the legitimate operation of the Program may be a violation of criminal and civil law, and, should such an attempt be made, Lionsgate reserves the right to seek damages from any such person to the fullest extent permitted by law. Lionsgate's failure to enforce any of these Rules and Regulations shall not constitute a waiver of that the affected provision, or any other, provision. All questions or disputes regarding an individual's eligibility for the Program, the earning, crediting or use of Sparks, or a Member's compliance with these Rules and Regulations will be resolved by Lionsgate in its sole discretion.

10. EXPERIENCE MALFUNCTIONS AND CONDUCT.

10.1 The Program Entities are not responsible for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, or difficulties, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Additionally, the Program Entities are not responsible or liable for any computer, programming, printer errors or the issuance of any unintended Sparks. In no event will Program Entities be liable for, and members expressly release the Program Entities from any claims as to the issuance of any unintended Sparks. If, for any reason, the Program is not capable of running as planned, including, due to errors of any kind or nature, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Lionsgate which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program, Lionsgate reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Program or otherwise respond to the circumstances as Lionsgate deems appropriate. In the event Lionsgate is prevented from continuing with the Program as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Lionsgate's control (each a "Force Majeure" event or occurrence), Lionsgate shall have the right to modify, suspend, or terminate the Program.

10.2 Any attempts by any Member to access the Program or Website via a bot script or other brute-force attack shall result in that Member becoming ineligible to participate in the Program. Lionsgate, in its sole discretion, reserves the right to disqualify and terminate participation of any Member found to be (i) tampering with the operation of the Program or the Website (ii) acting in violation of these Rules and Regulations (iii) violating the Terms of Service of the Website (iv) acting in an unethical or disruptive manner (v) acting with intent to annoy, abuse, threaten or harass Lionsgate, its representatives or any other Member in any manner related to the Program (vi) or tampering with, altering, or attempting to alter Sparks standings, (vii) tampering with, altering, attempting to alter, creating, attempting to create or duplicate Sparks, or (viii) colluding or attempting to collude with one or more Members to gain an unfair advantage by sharing knowledge or other information in order to earn Sparks.

11. LIMITATION OF LIABILITY.

11.1 The Program and Prizes are provided on an "AS IS" basis and without warranty, guaranty or representation of any kind, expressed or implied, including without limitation, any implied warranty of merchantability, fitness for a particular purpose and non-infringement. Lionsgate is not responsible for any assurances, guarantees, representations or warranties made or implied by any parties associated with or involved in the Program, including but not limited to any merchandisers, manufactures, suppliers or advertisers of a Prize. By participating in the Program, each Member accepts all responsibility for, and hereby indemnifies and holds harmless the Program Entities, from and against any claims that may arise from actions taken by such Member or for any unauthorized access to Member's Account by any third party.

11.2 UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL THE EXPERIENCE ENTITIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE EXPERIENCE, EVEN IF ANY OR ALL OF THE EXPERIENCE ENTITIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SUCH EXCLUSIONS MAY NOT APPLY TO YOU. IF A MEMBER PROVES THAT LIONSGATE HAS IMPROPERLY DENIED THAT MEMBER ANY SPARKS, LIABILITY WILL BE LIMITED TO THE EQUIVALENT AMOUNT OF SPARKS. BY PARTICIPATING IN THE EXPERIENCE, A MEMBER WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM MORE THAN ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED. EACH MEMBER SPECIFICALLY WAIVES ANY BENEFIT UNDER CALIFORNIA CIVIL CODE SECTION 1542 WHICH PROVIDES "A GENERAL RELEASE DOES NOT EXTEND TO UNKNOWN CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER WOULD HAVE MATERIALLY AFFECTED THE SETTLEMENT".

11.3 Notwithstanding any other provision of these Rules and Regulations, in the event there is a direct conflict between these Rules and Regulations and either the Website's or applicable Promotional Website's Terms of Service or the Website's or applicable Promotional Website's Privacy Policy, these Rules and Regulations will govern, control and prevail, as to the Program, including but not limited to those Rules and Regulations dealing with limitation of liability, arbitration, governing law and jurisdiction.

12. GOVERNING LAW/JURISDICTION.

12.1 ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE TERMS AND CONDITIONS OR THE RIGHTS AND OBLIGATIONS OF MEMBERS OR THE EXPERIENCE ENTITIES IN CONNECTION WITH THE EXPERIENCE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE UNITED STATES OF AMERICA. AND THE STATE OF CALIFORNIA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER JURISDICTION'S LAWS.

12.2 The state and federal courts located in Los Angeles, California shall have exclusive jurisdiction over any suit or other proceeding arising out of or based upon these Rules and Regulations, and by participating in the Program, each Member hereby waives any claim that he or she is not subject personally to the jurisdiction of said courts or that any such suit or other proceeding is brought in an inconvenient forum or improper venue.

12.3 If any provision of these Rules and Regulations is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Rules and Regulations, which will otherwise remain in full force and effect.

  1. ELIGIBILITY: "The Hunger Games: Panem Rising" Become a Part of Panem Rising Contest ("Contest") is open to legal residents of the fifty (50) United States or the District of Columbia, who are thirteen (13) years of age or older and have an internet connection at the time of entry ("Contestants"). Minors must get their parent or legal guardian’s permission to enter. Contest is void in Puerto Rico, the U.S. Virgin Islands, all other U.S. territories and possessions, and wherever else restricted or prohibited by law. The Contest is sponsored by Kabam, Inc., 795 Folsom Street, Suite 600, San Francisco, CA 94107 ("Sponsor"). Employees, officers, directors, agents, representatives of Sponsor, Lions Gate Films Inc. ("Lions Gate"), the legal, promotion, administrative and advertising agencies of any aforementioned entity, and each of their parent, affiliate and subsidiary companies (all such individuals and entities referred to collectively as the "Promotion Entities"), and their immediate family members (defined as spouse, mother, father, sisters, brothers, sons, daughters, uncles, aunts, nephews, nieces, grandparents and in-laws, regardless of where they live) and those living in their household (whether or not related), are not eligible. This Contest is subject to all applicable federal, state and local laws.

  2. MANDATORY FACEBOOK, TWITTER, GOOGLE+, AND TUMBLR DISCLOSURE: This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Google+, or Tumblr. You are providing your information to Sponsor and not to Facebook, Twitter, Google+, or Tumblr. Lions Gate is not responsible for the sponsorship and/or administration of this Contest.

  3. CONTEST PERIOD: The Contest Period begins on October 24, 2014 at 12:01 AM Pacific Daylight Time ("PDT"), and ends on November 2, 2014 at 11:59 PM Pacific Standard Time ("PST") (the "Contest Period"). ALL ENTRIES MUST BE SUBMITTED DURING THE CONTEST PERIOD. By participating, Contestants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this Contest.

  4. HOW TO ENTER: Online Submissions (as defined below) only.

    First, you must create your Submission.

    Create a likeness of yourself that is appropriate to use as a card in the "The Hunger Games: Panem Rising" game (the "Game"). Your submission may be a color or black and white photograph or a drawing of yourself costumed and/or staged as a rebel from one of the six districts in the Game (the "Submission"). Your Submission must be compliant with the "Submission Guidelines" as set forth in these Official Rules, and may be posted publicly and should be acceptable for all viewing audiences

    Your Submission must meet the following technical guidelines in addition to the Submission Guidelines as set forth below:

    • The Submission must be in .jpg, .png, or .gif formats;
    • The Submission must not exceed 1MB in size;

    Next, enter your Submission into the Contest.

    To submit your entry go to www.thehungergamesexplorer.com (the "Website") and upload your Submission by following the on-screen instructions. Upon completion and submission of the Submission, you will receive one (1) entry in the Contest. Once you have completed and submitted your Submission, you will be given the option to share with your friends that you’ve entered the Contest through you’re the available linked social media account(s).

    Limit one (1) Submission per Contestant and/or email address will be accepted.

    All required information provided during the entry process must be current, accurate, and valid in order to enter and be eligible to win. Submissions must be received no later than November 2, 2014 at 11:59 PM PST according to Sponsor’s time (which is the official timekeeper for the Contest). Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of such entry. Submission must be made by the Contestant, only at the Website. Submissions made by any other individual or any entity, and/or originating at any other web site or e-mail address, including but not limited to commercial promotion subscription notification and/or entering service sites, will be declared invalid and disqualified for this Contest. Tampering with the entry process or the operation of the Contest, including but not limited to the use of any device to automate the entry process, is prohibited and any submissions deemed by Sponsor, in its sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted a Submission cannot be resolved to Sponsor’s satisfaction, the affected submission(s) will be deemed ineligible. The Promotion Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of the entries in the Contest. The Promotion Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of submissions.

  5. SUBMISSION GUIDELINES: There are some limits on what you can do:

    • Your Submission may not show any individual other than you and must not have previously won any prize or award
    • Please, do not use your Submission to launch personal attacks on anyone or any discernable product, including competitor products.
    • Submission may not depict nudity, animal cruelty, or illegal activity or substance, or offensive or obscene subject matter as determined in Sponsor’s sole discretion.
    • Submission shall not portray Sponsor, Lions Gate or the Game in a negative light.
    • Submissions must be appropriate for a broad audience since the winning Submission may be posted publicly.
    • Submissions should not feature any trademarks (including logos), tradedress, trade secrets of any third parties.
    • Submissions must be original works of authorship, created by the person who submits the entry. Contestants may not copy or otherwise plagiarize the Submission from any source, nor may the photo include third-party copyrighted material or artwork, without the copyright holder’s permission. By entering, you warrant that your Submission does not infringe any third party’s rights, and that you have obtained any necessary permissions from all relevant third parties to submit the Submission. Any images used in the Submission must be an original work of authorship under U.S. Copyright Law.
    • You may not be, nor may you use in your Submission parties who: 1) are represented under contract (e.g., by a talent agent or manager) that would limit or impair our ability to show the Submission in any media form; 2) have an acting or modeling contract that would make your/their appearance in the Submission a violation of any third party rights; 3) are under a merchandising agreement; or 4) are under any other contractual relationship, including but not limited to guild and/or union memberships, that may prohibit them from participating fully in this promotion, or from allowing us to use the Submission online and in television and any and all media.
    • Submission must not violate the rights of any third parties, including intellectual property rights, rights of privacy, or any other rights held by third parties.
  6. WINNER SELECTION AND NOTIFICATION: After the Contest Period, all eligible entries will be subject to rounds of judging:

    Public Voting Round: After the Contest Period, eligible entries will be posted in a gallery on the Website where the public will be invited to vote on which Submission they believe has the most public appeal using sparks (the "Public Voting Period"). Contestants may also share their Submissions through Facebook, Twitter, Google+, and Tumblr. The number of sparks your Submission receives will be counted towards your Submission’s score and be considered as one of the criteria in the second round of judging.

    Judging Round: Eligible Submissions will be reviewed and scored by a panel of qualified judges, according to the following criteria, on a 100-point scale:

    • Number of Votes (20 points)
    • Creativity (40 points)
    • Relevance to the Theme (40 points)

    The eight (8) highest scoring eligible Submissions will be deemed the potential Grand Prize winners ("Finalists").

    In case of a tie, the tying submissions will be rescored with the Relevance to the Theme criteria receiving double value.

    At any time before, during or after the Contest Period, Sponsor may, in its discretion, choose to post or distribute one or more Submissions, the Contestant’s name and profile information online (including Facebook pages, Twitter feeds, YouTube channels, and third-party websites) for promotional and entertainment purposes only. Posting of this/these Submission(s) will not mean that said Submissions are eligible to win or are a Finalist. Contestants understand that users of these sites may share, comment on (including negatively), and re-post their Submissions. Any requests by Contestants to have a Submission removed from consideration will be accommodated to the extent practically possible. Sponsor is not responsible for third party re-posting of Submissions.

    Finalists will be notified by email according to Sponsor’s sole discretion on or about November 3, 2014 and will be required to respond (as directed) to the notification within seventy-two (72) hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the Prizes; and, in such case, Sponsor may choose the next highest scoring entry from among the remaining eligible entries. The Finalist may be sent a declaration of eligibility / liability / publicity release ("Release"). Finalists may be required to submit additional photographs of themselves showing various angles in order to create the "Rebel" card featuring the contestant likeness. If a Finalist fails to provide these additional materials, or meet other requirements as set forth in these Official Rules, the Finalist may be disqualified and Sponsor may choose the next highest scoring entry from among the remaining eligible Submissions. If a minor is a Finalist, the Release must be signed by a parent or legal guardian. Unless restricted by law, Finalist will be required to complete and return the Release within seventy-two (72) hours of the date Release is sent.

  7. License and ASSIGNMENT: As a condition of entry, Sponsor hereby provides you a thirty (30) day non-exclusive limited license to use Sponsor’s intellectual property in conjunction with your Submission for the limited purpose of entering the Contest. By entering the Contest, you hereby assign to Sponsor all rights, title and interest of every kind and character throughout the world that you may have in the Submission, and any and all other material submitted to Sponsor, or created in conjunction therewith, including the final "Rebel" card. Contestants must provide Sponsor with all required paperwork and return all documents in a timely manner as required pursuant to these Official Rules in order to be eligible to receive the prize. Contestants may not sell, assign or transfer any of their rights in their Submissions under these Official Rules except as set forth in this paragraph.

    CONTESTANTS WILL NOT BE PAID FOR THEIR SUBMISSIONS OR FOR GRANTING SPONSOR ANY OF THESE RIGHTS.

    Contestant understands and acknowledges that his or her Submission may be altered from its original form and that Sponsor reserves the right to modify the Submission in its sole discretion, without any limitation. Sponsor may post Submissions in any order or sequence, with or without commentary, and may select the Submission to serve as a thumbnail in its sole discretion.

  8. PRIZE:

    Eight (8) Grand Prizes: Up to eight (8) Grand Prize Finalists will be selected to have their likeness portrayed as a "Rebel" on a card in the game. Approximate Retail Value: $5.00 USD

    All federal, state and local taxes and other expenses in connection with the prize are the sole responsibility of the Selected Contestant. Contestants may be issued an IRS Form 1099 for the ARV of any awarded prize. Selected Contestant is solely responsible for any other unspecified expenses related to prize. All activities related to the prize, are at the Selected Contestant’s own risk and subject to whatever restrictions are imposed by the entities that govern activities. Selected Contestant is not entitled to any surplus between actual retail value of prize and stated ARV and any difference between stated ARV and actual value of the prize will not be awarded. No substitution, transfer, or cash redemption of prize, provided however that Sponsor reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. In the event of noncompliance with the foregoing requirements or if prize notification is returned as undeliverable, prize will be forfeited and, at Sponsor’s discretion, an alternate Selected Contestant may be selected.

    Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the Sweepstakes. Only the type and quantity of prizes described in these Official Rules will be awarded. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF CALIFORNIA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.

  11. PUBLICITY: Sponsor reserves the right to use the name, likeness, and/or hometown name of any Contestant, including his/her Submission or photograph, for publicity purposes prior to, during, or after the Contest end date, in any media, throughout the world, in perpetuity, without any compensation or prior review unless specifically prohibited by law.

  12. ARBITRATION PROVISION: By participating in this Contest, each entrant (and any minor entrant’s parent or legal guardian) agrees that any and all disputes the entrant may have with, or claims entrant may have against, the Promotion Entities relating to, arising out of or connected in any way with (i) the Contest, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of this agreement to arbitrate, will be resolved individually and exclusively by final and binding arbitration administered by the National Arbitration Forum (the "Forum") and conducted before a sole arbitrator pursuant to the Code of Procedure established by the Forum. The arbitration shall be held at a location determined by the Forum pursuant to the Code of Procedure, or at such other location as may be mutually agreed by the participant and Sponsor. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Contest. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the participant’s and/or Sponsor’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. The arbitrator shall not have the power to award punitive damages against the participant or Sponsor.   13. PRIVACY: All personal information collected by Sponsor will be used for administration of the Contest. In addition, Contestants may receive email correspondence from, or on behalf of Sponsor subject to Sponsor’s privacy policy. Sponsor uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines, and Contestants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email. Any questions regarding privacy matters should be directed to the address set out below. Please refer to Sponsor’s privacy policy located at https://www.kabam.com for important information regarding the collection, use and disclosure of personal information by Sponsor.

  14. OFFICIAL RULES and WINNERS LIST: The Official Rules will be posted on the Website during the Contest Period.
